Senator Smith moved to amend the bill on page 1, section 5c, lines 11 and 12, by striking out all of subsection (c) and inserting in lieu thereof a new subsection (c), to read as follows:

(c) The authority shall propose rules for legislative approval and promulgate emergency rules in accordance with the provisions of §29A-3-1 et seq. of this code to implement this section, including exempting power plants that have been non-producing for at least five years from the effective date of this section.
